1.4. All singular references include plural and vice versa. Gendered terms include all genders.
2. Use of Services
2.1. Accessing or using the Website implies acceptance of these Terms and applicable law. You are solely responsible for legal compliance in your jurisdiction.
2.2. The Website offers a non-custodial cryptocurrency exchange service using ChangeNOW’s API. You may not exchange fiat currency via the Website.
2.3. By using the Website, you confirm that:
You are at least 18 years old.
You use legally obtained funds.
You are not a resident of a prohibited jurisdiction (see Section 10).
You understand that cryptocurrency transactions involve financial risk.
You will not use the Website for commercial purposes or represent third parties.
You agree to receive all communications electronically.
You will not use proxies, VPNs, or software to mask your IP address.
You will not misuse or reverse engineer the platform.
2.4. The Website may be unavailable during maintenance. Incexchange reserves the right to restrict or block access at its sole discretion.
3. AML/KYC Compliance
3.1. No account is required. However, transactions are monitored using ChangeNOW’s automated risk management system.
3.2. You agree to complete the AML/KYC procedure if requested. This may include submitting documents and information about the origin of funds.
3.3. If you refuse, your transactions may be suspended or declined.
3.4. The platform reserves the right to freeze transactions while identity verification is in progress.
4. Personal Data
4.1. By using the Website, you consent to the processing and international transfer of your personal data.

5. Rates, Pricing, and Payments
5.1. Cryptocurrencies are volatile and experimental in nature.
5.2. Exchange rates are calculated at the time payment is received, not when it is sent.
5.3. All service fees are included in the exchange rate unless otherwise stated.
5.4. Taxes are your responsibility. We do not report or withhold taxes on your behalf.
6. Refund and Cancellation Policy
6.1. Most transactions are irreversible. Refunds are only possible in limited cases.
6.2. Refunds may be issued if:

The exchange failed or remained in “Awaiting payment” status.

6.5. We do not refund unsupported assets, small amounts below the minimum, or transactions sent to incorrect addresses.

7. Indemnification
You agree to indemnify and hold harmless Incexchange and its affiliates from any claims, damages, or liabilities arising from your breach of these Terms or misuse of the services.

8.2. We do not guarantee uninterrupted access, error-free operation, or accuracy of the exchange rates.
9. Limitation of Liability

9.2. Our maximum liability to you will not exceed 500 EUR per incident.
10. Prohibited Jurisdictions
10.1. Users from the following countries may not use the Website: USA, North Korea, Iran, Syria, Sudan, Cuba, Crimea, Bangladesh, Bolivia, and countries sanctioned by the UN Security Council.
10.2. We reserve the right to block users based on IP geolocation and to seize and donate funds from prohibited jurisdictions.
